THE ISSUE
Save Our County is an organization of concerned citizens from northern New Castle County who advocate balance in community development. The group formed during the Barley Mill Plaza ordeal, hoping to sway County Council to vote against the rezoning project. County Council approved the Barley Mill rezoning project by a narrow vote of 7-6 in late October.
On Tuesday, Dec. 27, Save Our County and four individual plaintiffs filed suit against New Castle County in the Delaware Court of Chancery, stating that not enough traffic data was completed in order to make a wise vote for the community.
WHAT WE’VE REPORTED
County Council approved the proposal from Stoltz Real Estate Partners despite several years of local and regional opposition. The Barley Mill Plaza site, located along Route 141, was purchased by Stoltz from DuPont in 2007, and is slated to be developed as a 1.65 million square feet mixed-use town center with retail and office components.
WHAT’S NEXT
“The lawsuit seeks simply to ensure that our decision makers follow the law and review all relevant and appropriate data in order to make informed decisions on behalf of county residents,” said attorney Joseph Kelly, a long-time member of Save Our County.
Kelly said he was shocked that a project of this size was ever approved.

The suit states that the “commercial rezoning for the project was inappropriately granted for a site primarily surrounded by residential and low impact uses, and where significant traffic congestion and other problems already exist.”
The defendants in the case include David Culver, general manager of the Land Use Department, New Castle County, County Council, the Department of Land Use, and Barley Mill, LLC. The individual plaintiffs are residents whose homes are located near the Barley Mill plaza site.
