Civic group vows to remain vigilant during construction on Hercules Road neighborhood

The Milltown-Limestone Civic Alliance has been battling with Toll Brothers for more than five years over plans for Greenville Overlook, a 160-unit subdivision on the back nine holes of the former Hercules Golf Course. The civic group is concerned the developer will do a sub par job on site remediation of the soil contaminated by pesticides and helped homeowners file a suit against Toll Brothers in Chancery Court requesting a temporary restraining order.

The suit against Toll Brothers was dismissed. The two parties neared settlement, but the MLCA ran out of money to keep fighting the case, said Bill Dunn, vice president of the MLCA. The civic group’s suit against New Castle County, filed because MLCA felt the county was wrong in approving Toll Brothers’ plans, was also dismissed from Superior Court.

What’s next

MLCA is urging residents to remain vigilant as Toll Brothers develops the site – work began on April 20 – and call DNREC immediately if they see dust on the property, Dunn said. The group is also leaning on legislators, DNREC and Gov. Markell to ensure each are doing their job to protect the interests of residents, he said. MLCA has enough money left for a short-term argument in court, Dunn said, and if there are numerous dust complaints, the group has not ruled out refiling its suit against Toll Brothers.
